Apple could go to commercial court following Athenry judicial review applications

Galway Bay fm newsroom – Tech giant Apple could go to the commercial court after three people applied for a judicial review over its plans for an 850 million euro data centre in Athenry.

Apple has expressed concern to senior Irish enterprise officials about the implications of a potential judicial review.

Three people have been given the go-ahead to seek a review of a decision made by An Bord Pleanála to allow the project go ahead.

Locals Allan Daly and Sinéad Fitzpatrick originally objected to the project during the planning stages and have now been granted an ex-parte judicial review application.

The third person who wants a judicial review, Brian McDonagh, is understood to be living in the east of the country and lodged a separate request.

The High Court has granted an ex-parte judicial review hearing in respect of each application.

The case relating to the two local applications is due for mention in the High Court on November 8th – it’s not yet known if a full judicial review into the matter will be granted.

In cases like this, companies have the option of having their case examined by the commercial court.

It is not yet known if Apple will avail of this option, but if it does, the tech giant is likely to lodge an application to the commercial court in the coming weeks.
